Behind every locked door was a business unable to serve its customers. Behind every empty counter was an employee whose livelihood had been placed in jeopardy. And among the hundreds of Apotheca team members who traveled to Raleigh were people who have built not merely jobs, but meaningful careers in an industry that has given them opportunities few other businesses could have offered.

Apotheca was not alone. Operators from across North Carolina also closed their doors, and more than a thousand people ultimately gathered in Raleigh to express their opposition to the conference report on HB 328. They came as employees, entrepreneurs, customers, veterans, retirees, family members, and citizens. They came peacefully, professionally, and with a simple request: regulate this industry responsibly, but do not destroy it.

“Our team understood exactly what the day represented, and they carried themselves with tremendous professionalism,” said Jordan Minor, Apotheca’s Director of Marketing. “There was a real sense of unity—not just among our employees, but throughout the entire industry. People showed up with respect, optimism, and a sincere desire to be heard. It was one of those rare days when you could actually feel that we were making a difference.”

The gathering was not intended to hammer political opponents or humiliate anyone who held a different position. Its purpose was persuasion. We wanted lawmakers to see the people behind the legislation and understand that hemp is not an abstract policy debate. It is a 4 billion-dollar North Carolina industry supporting businesses, families, and communities across the state.

At the heart of our position is a thoroughly American idea: adults should have the freedom to make informed choices about their own lives. That principle crosses party lines, regional boundaries, and cultural divisions. Cannabis may be one of the most surprisingly unifying issues in American politics, bringing together people who might disagree on almost everything else.

That spirit was alive in Raleigh. The industry spoke, legislators listened, and for now, North Carolina appears to be moving in a more constructive direction.

This was not a victory lap. It was evidence of what can happen when people approach disagreement with respect, stand together for something they believe in, and leave the door open for conversation. Apotheca is deeply grateful to every employee, customer, operator, and supporter who helped make that day possible.

Our hope is that the conversation continues—and that North Carolina ultimately becomes a national leader in sensible cannabis policy, protecting adult freedom while allowing a responsible and flourishing industry to remain part of our state’s future.

House Bill 328 did not receive a vote in the North Carolina House, and lawmakers are not expected to consider additional hemp legislation for at least several months—possibly not until next year. The bill is not officially dead. In Raleigh, legislation has a habit of lingering in committee like an uninvited guest who refuses to take the hint. But in practical terms, the version of HB 328 that threatened most of North Carolina’s hemp industry has reached the end of its immediate road.

The Senate had already adopted the conference report, and House leaders had previously indicated that they expected to do the same. That changed after business owners, employees, consumers and advocates raised serious questions about the bill’s consequences. Hundreds traveled to Raleigh, packed the Legislative Building and asked lawmakers to reconsider.

After consulting with members of his caucus, House Speaker Destin Hall pulled the bill from consideration. He has since announced plans to appoint a small group of House lawmakers to study the issue and develop new proposals. The General Assembly is not expected to hold additional votes until after the November election, and any future hemp legislation will likely look substantially different from the current conference report.

That is the news. But it is not the end of the story.

A False Choice North Carolina Never Had to Make

The most frustrating aspect of HB 328 was the suggestion that North Carolina had to choose between protecting children and preserving its hemp industry.

That choice was never real.

An earlier version of the legislation—developed with substantial input from responsible members of the industry—would have established a genuine regulatory system. It included:

• A minimum purchase age of 21;

• Licensing for manufacturers, distributors and retailers;

• Independent laboratory testing;

• Packaging and labeling standards;

• Online age verification;

• Restrictions on products designed to appeal to children;

• Meaningful civil and criminal penalties for violations.

Those provisions addressed legitimate concerns surrounding an underregulated market. They would have protected young people, given law enforcement clear authority to act against irresponsible operators and created uniform standards for businesses selling hemp-derived products in North Carolina.

The final conference report took a far different approach. Rather than regulating the market, it would have eliminated most of it.

We understand the concerns raised by legislators, prosecutors and law enforcement officials. Products should not be sold to minors. Packaging should not imitate children’s candy. Labels should be accurate. Products should be tested, retailers should be accountable and bad actors should face real consequences. On those points, there is far more agreement than the recent political debate might suggest. The disagreement is over whether the answer should be regulation or prohibition.

The Industry Showed Up

When HB 328 became an existential threat, North Carolina’s hemp community responded.

Business owners closed stores and traveled to Raleigh. Employees left their regular routines behind and walked into the Legislative Building. Consumers called and emailed their representatives. Veterans, retirees, advocates and families explained what these products—and the businesses providing them—mean in their lives and communities.

House members reported receiving an extraordinary volume of constituent communication. The halls in Raleigh filled with people who were serious, respectful and determined to be heard.

This was not some counterculture carnival crashing the Capitol. It was an industry standing up for its employees, customers and future. It was democracy in its most basic form: citizens showing up, presenting their case and asking elected officials to listen.

And they did.

The decision not to vote on HB 328 demonstrates that organized, informed and respectful advocacy can change the course of legislation. It also gives lawmakers and the industry a chance to lower the temperature and return to the hard but necessary work of developing responsible policy.

The Federal Clock Is Still Ticking

North Carolina’s debate is unfolding beneath an even larger federal threat.

A provision included in a federal spending law enacted in November 2025 is scheduled to dramatically redefine legal hemp beginning November 12, 2026. Unless Congress intervenes, the new definition could remove most currently available hemp-derived products from the lawful market.

There are, however, signs that Washington may be reconsidering that approach. In June, the Trump administration urged Congress to replace the looming prohibition with a regulatory framework—or at minimum delay its implementation. Bipartisan federal legislation has also been introduced to preserve lawful hemp commerce while establishing age restrictions, testing requirements, packaging standards and other consumer protections.

None of this guarantees an outcome. It does mean that neither the state nor federal debate is settled.

What Comes Next

HB 328 remains in the House Rules Committee and could theoretically return. More importantly, North Carolina still needs meaningful hemp legislation.

The absence of a statewide minimum purchase age and uniform product standards is neither desirable nor sustainable. Responsible businesses should not be asked to defend a regulatory vacuum. We have been asking for clear rules, strong enforcement and real accountability for years.

The path forward is not mysterious:

Establish a minimum age of 21. License manufacturers, distributors and retailers. Require independent testing, responsible packaging and accurate labels. Give regulators the authority to inspect products and trace them through the supply chain. Remove dangerous or deceptively marketed products. Punish businesses that sell to minors or knowingly violate the law.

Do all of that without criminalizing an entire lawful industry or forcing adult consumers into an illegal market.

HB 328 did not pass. The industry showed up. Lawmakers listened. Regulation remains possible, and prohibition is not inevitable.

That is worth recognizing—but not celebrating as though the larger fight has been won. What North Carolina has received is something more valuable than a victory lap: a second chance.

Now we must use it well.

When we came to Raleigh, we did not come to disrupt the legislative process or create conflict. We came humbly and respectfully to ask that common sense prevail—and to ensure that the people whose jobs, businesses, farms, and families would be directly affected had an opportunity to be heard.

We also recognize that the concerns underlying this debate are real. Protecting children, ensuring product safety, establishing responsible age restrictions, and holding businesses accountable are goals we share. Apotheca has consistently supported sensible regulation, comprehensive product testing, clear labeling, and strong safeguards preventing sales to anyone under the age of 21. These principles are not obstacles to our industry. They are essential to its future.

Our most visible advertising campaign, “Gummies for Granny,” has appeared on billboards and television screens across North Carolina. While the name may be lighthearted, its message reflects something important: the people who visit our stores are not part of some narrow counterculture. They are parents, grandparents, veterans, retirees, working professionals, and neighbors from communities across the state. They come from every political party and every walk of life.

Few issues in American public life create meaningful agreement among Republicans, Democrats, and independents. Sensible cannabis policy is one of them. We see that common ground every day in our stores. Our customers may disagree about many things, but they overwhelmingly agree that adults should have access to safe, responsibly produced products—and that those products should exist within a clear and well-regulated marketplace.

North Carolina now has an opportunity to lead the nation.

The state’s hemp industry represents an estimated $4.4 billion in economic activity and supports more than 16,000 jobs, many of which pay above-average wages. It is creating opportunities for farmers, revitalizing storefronts, supporting local communities, and generating new economic activity throughout the state. We believe thoughtful legislation can accomplish what everyone wants: keep products away from children, require meaningful testing and accountability, protect responsible businesses and their employees, support North Carolina agriculture, and generate substantial revenue for the state. These goals do not have to compete with one another. With the right framework, they can reinforce one another.

That is the work ahead of us.

We respectfully ask North Carolina’s elected leaders, regulators, farmers, industry representatives, and consumers to come together and develop a model that can become a national standard. Let us demonstrate that difficult legislation does not have to be divisive. Let us show that public safety and economic opportunity can coexist—and that people with different political perspectives can still work together toward a responsible solution.

This moment should not mark the end of a fight. It should mark the beginning of a partnership.

Originally introduced in the North Carolina House, H328 focused on two primary issues: establishing age restrictions for hemp products and prohibiting hemp, tobacco, and vapor products on school grounds. The bill passed the House with broad bipartisan support.

However, after reaching the Senate, portions of the legislation were significantly rewritten. According to industry advocates, the revised language would have extended far beyond age restrictions by creating provisions that could effectively prohibit many hemp products currently available in North Carolina due to the way they are manufactured.

Because the House did not agree with the Senate’s changes, the legislation moved to a conference committee, where members from both chambers were tasked with negotiating a final version of the bill.

Industry representatives closely monitoring the negotiations expressed concern that the committee’s proposal closely mirrored language found in pending federal legislation that many believe would dramatically restrict hemp-derived cannabinoid products.

The conference committee completed its work, but before the measure could receive a vote on the House floor, House Republicans met in caucus to determine whether to move the conference report forward. Following outreach from hemp businesses, employees, and advocates across the state, the caucus declined to bring the report to the House floor for a vote.

For now, that means the conference report has not advanced.

It is important to note, however, that this is not the end of the legislative process. The conference report may still be brought back for consideration during a future meeting, meaning the issue remains very much alive as lawmakers continue negotiations.

The current pause also highlights an important distinction that many within the hemp industry have emphasized throughout this debate. Businesses have consistently supported commonsense regulations, including minimum age requirements, product testing, accurate labeling, child-resistant packaging, and responsible retail standards. Their concern is that the latest version of H328 extends well beyond regulation and instead operates as a de facto ban on many federally legal hemp products.

The new law changes what retailers can legally sell and, for many consumers, what products they can purchase. While the legislation removes several familiar product categories from store shelves, it also leaves an important segment of the market intact, allowing hemp-derived THC beverages and edible products to remain available under Tennessee’s revised regulatory framework.

Among the biggest changes is the prohibition of traditional THCA smokable products. THCA flower, pre-rolls, vape cartridges, disposable vapes, and concentrates are no longer permitted for retail sale under the state’s updated rules. Certain other intoxicating cannabinoids have also been affected by the legislation, substantially narrowing the range of products available compared with previous years.

For customers accustomed to purchasing these products, the change is significant. THCA flower had become one of the most popular categories in Tennessee’s hemp market, and its removal represents a major shift for both retailers and consumers.

Despite those restrictions, Tennessee’s legal cannabis market has not disappeared.

Hemp-derived Delta-9 THC beverages and edible products remain legal, provided they comply with the state’s revised serving, packaging, and labeling requirements. These products contain the same primary psychoactive cannabinoid found in cannabis products sold through regulated adult-use markets in states such as Colorado, Michigan, and California.

Industry observers note that this remaining category also happens to be one of the fastest-growing segments of the broader cannabis industry. Across mature legal markets, beverages and edibles have steadily expanded their share of consumer demand, attracting not only experienced cannabis consumers but also adults seeking alternatives to alcohol or traditional smokable products.

That trend is expected to continue in Tennessee as consumers adapt to the state’s new regulatory landscape.

Retailers are likewise adjusting their product offerings. Many stores are expanding their beverage and edible selections while introducing compliant alternatives for customers seeking familiar product formats where state law still allows.

The transition has not been without challenges. Businesses throughout Tennessee have spent months evaluating inventory, educating employees, and helping customers understand the practical effects of the new regulations.

At the same time, many within the hemp industry continue to advocate for regulatory approaches they believe protect consumers without unnecessarily limiting access to legal products. Industry organizations have consistently voiced support for age restrictions, product testing, accurate labeling, and responsible retail standards while expressing concern that outright product bans reduce consumer choice and create uncertainty for legitimate businesses.

For Tennessee consumers, the immediate takeaway is straightforward: the state’s hemp market has changed substantially, but legal cannabis products remain available.

Drinks and edibles now represent the center of Tennessee’s regulated hemp market, reflecting not only the state’s revised laws but also broader consumer trends occurring across the country.

I graduated college in 1990, stepping out from the wilderness of East Carolina into the electric hum of Los Angeles. Back then, weed was already knocking on the door of mainstream America, but it was a whole different beast from what I’d known. At East Carolina, the cannabis selection was humble: mostly shake, seeds, and whatever your buddy could scrape together. We were lucky to get a decent joint without a mouthful of stems or the occasional, dreaded twig.

Then came LA. Suddenly, I found myself in weed heaven. The black market was not only robust—it was downright sophisticated. I remember having weed delivered right to my office. No kidding. Some guy would show up, like a pizza guy for pot. The stuff was good too. Not the swishy, droopy leaf kind from back east, but the pungent, sticky, resin-drenched flowers that could actually knock you on your ass. But is it the same weed you find today? Hell no.

Cultivation: From Sun-Kissed Fields to High-Tech Fortresses

Back in the 1990s, outdoor grows ruled the landscape, at least in places where the weather cooperated. In California, that meant sun, soil, and seasons dictated the quality and quantity of your stash. Indoor cultivation was just getting its footing—growers tinkering in basements and warehouses, figuring out lights and ventilation. It was science, but still a bit of a wild west experiment.

Fast forward to today, and indoor cultivation has become the gold standard. It's like comparing a backyard barbecue to a NASA space station. Growers now wield precise control over light, temperature, humidity, and even carbon dioxide levels. This means consistent, potent harvests that can hit THC levels that would have made 1990s me drop the joint and crawl under the desk. The old days? A typical joint might have had 5-10% THC. Now? It’s not uncommon to see flower packing 25% or more, with concentrates reaching mind-boggling heights.

Products: From Simple Joints to a Galaxy of Options

The ‘90s were all about the flower. If you wanted to get high, you smoked dried buds rolled in paper or packed into pipes and bongs. Concentrates existed but were niche—hash being the classic, passed around in small circles, often imported from places like Morocco or Afghanistan. Edibles? Maybe homemade brownies if you were lucky, but nothing close to today’s industrially produced gummies, chocolates, or beverages.

Today’s cannabis landscape looks like something out of a sci-fi novel. Edibles are everywhere—from gummies that taste like candy to infused coffees and sodas. Concentrates come in dozens of forms: wax, shatter, live resin, distillate, and vape cartridges that promise a discreet, potent hit. The rise of vape pens is both a blessing and a headache, but undeniably changed the game. And let’s not forget the microdosing trend, where a few milligrams of THC or CBD can ease anxiety or boost focus without sending you to the couch.

Social Perception: From Pariah to Pop Culture Icon

In the ‘90s, cannabis was still very much in the shadows. The stigma was thick, reinforced by decades of prohibition propaganda. Being caught with weed could ruin your life, and it was easy to feel like a deviant—even among fellow college kids. Yet, the medical marijuana movement was bubbling under the surface, with patients and advocates fighting for recognition and legitimacy.

Today, that world feels light years away. Recreational cannabis is legal in over 20 states, with countless more easing restrictions or legalizing medical use. Cannabis is no longer the outlaw drug whispered about in dark alleys. It’s a booming industry with glossy dispensaries, celebrity endorsements, and a mainstream cultural embrace that includes everything from hip-hop anthems to wellness influencers touting CBD oils.

So What’s Changed? Everything and Nothing

The plant itself? Still Cannabis sativa (and its cousins). But how it’s grown, consumed, and perceived has undergone a revolution. The 1990s offered a rough draft—smoke it and hope for the best. Today, science and capital have refined cannabis into a controlled, predictable experience, one that appeals to everyone from the stoner poet to the corporate executive looking for a better night’s sleep.

Personally, I stand somewhere in the middle—a relic of the shake and seeds era who now finds himself navigating the dizzying array of products and strains with a mix of wonder and mild suspicion. The weed I had delivered to my LA office was a revelation in its time. The weed I consume now? It’s like stepping into a new world entirely, one where cannabis isn’t just a recreational escape but a complex botanical cocktail with endless potential.

The only thing constant in this ch, ch, changing cannabis landscape is change itself. And frankly, I’m here for the ride.

If democracy truly worked the way the civics textbooks promised, cannabis would have been federally legal back when Cheech and Chong were considered young upstarts. Today, public support for legal marijuana is higher than ever—pun intended. Yet, despite America’s overwhelming thumbs-up on weed, some of the country's biggest institutions are still clutching their pearls.

Here at Apotheca, we’ve seen it firsthand. We open stores, offer carefully vetted, legally compliant products, and preach the good gospel of responsible cannabis use. But you’d think we were selling radioactive waste, judging by the reactions from social media platforms and major media companies who slam the digital doors in our faces and refuse our ad dollars. Money talks, but apparently, cannabis cash whispers.

Let’s face it—America loves weed. And when we say America, we’re not just talking about Willie Nelson and Snoop Dogg (God bless ‘em). A recent poll from Performance Research and Full Circle Research revealed that a solid majority of sports fans—from NFL diehards to NASCAR junkies, NBA hoopheads to Wimbledon obsessives—think it’s perfectly acceptable for cannabis companies to sponsor their favorite teams. And why wouldn’t they? Cannabis companies represent relaxation, good vibes, and, let's not forget, substantial economic opportunities.

But here’s the rub: Even though fans and everyday citizens are onboard, most professional teams treat cannabis partnerships like a radioactive hot potato. Sure, they'll take sponsorship dollars from beer companies promoting alcohol, the drug that’s been fueling questionable decisions since humanity first stomped grapes. But cannabis? Suddenly everyone turns into the town preacher.

What gives?

It’s not exactly a mystery. Behind the scenes, pulling the strings, lurk two of America's most influential lobbies: Big Pharma and Big Alcohol. These are the folks who write enormous checks to politicians, pay millions to media companies, and have cozy relationships with the same social platforms that ban cannabis advertisements faster than you can say "terms of service violation."

Let's unpack that for a moment. Big Pharma—the industry that brought you the opioid crisis, side effects lists longer than a CVS receipt, and drugs for restless leg syndrome (seriously, that’s a thing)—wants you nowhere near a safe, natural alternative to prescription meds. If Americans turn to cannabis instead of opioids, anti-anxiety pills, and sleeping tablets, their profit margins could shrink from obscene to merely enormous.

Then there’s Big Alcohol. These purveyors of hangovers and bad karaoke nights have built empires selling a drug directly responsible for millions of deaths globally each year. Cannabis legalization threatens their bottom line as more adults opt for gummies and THC seltzers rather than beer and whiskey. So what do they do? They lobby, they fund campaigns, and they pressure institutions into keeping cannabis on the outside looking in.

But here’s the thing about progress: It’s stubborn. It keeps knocking on the door until you let it in—or until it kicks the door down. Americans have spoken loud and clear: cannabis legalization is a no-brainer. It’s one of the few issues today where your Trump-loving uncle and your Bernie-supporting cousin might actually high-five in agreement.

Yet our leaders, institutions, and corporate bigwigs are lagging like a middle-aged dad in a footrace against Usain Bolt. How much longer can they keep up this charade? Not long, friends. Not long.

Cannabis is already a multi-billion-dollar industry—and growing faster than Big Pharma can say "Ask your doctor if this wildly overpriced pill is right for you." Sports teams, businesses, and media companies that continue to ignore cannabis are turning down revenue, ignoring their customers, and, frankly, making fools of themselves.

At Apotheca, we're done playing nice. We’re not asking for permission anymore; we're demanding our rightful place in the conversation. We're not just a dispensary; we're a part of a cultural shift toward wellness, choice, and freedom. The people have voted. The poll numbers don’t lie.

So here's a friendly message to Big Pharma, Big Alcohol, and every major media platform stubbornly holding onto prohibition-era prejudices: You can join the future or get steamrolled by it. Cannabis isn't going away. Neither are we.

Pass the popcorn—this is gonna be fun.

If you told me that legalizing cannabis could reduce teen usage, save lives by averting overdoses, shrink crime, boost tax coffers, and even improve public health outcomes—all while nudging people away from tobacco and alcohol—I’d say you’re either smoking something or onto something. Turns out, you’re onto something. A decade of data suggests that legalizing adult access to cannabis often correlates with lower adolescent use, not higher. One study of Washington state found that legalization caused a 22 percent drop in 8th‑grade cannabis use, and a 12.7 percent drop among 10th graders, with no increase in 12th graders. That is consistent with other states where youth trends track similarly regardless of legalization status. In a more general sense, federal data shows current adolescent marijuana use declining nationwide from 23.1 percent in 2011 to 15.8 percent in 2021, and first‑time use before age 13 falling from 8.1 to 4.9 percent—a long‑term drop that coincides with increasing legalization, not a surge in it.

Now as for opioids, the claim that cannabis access reduces overdose deaths is more contested. Early research did suggest that states with medical cannabis programs had about 24.8 percent lower opioid overdose mortality compared with states without such laws but later investigations—including a Stanford re‑analysis—found no consistent effect of legal marijuana on overdose death rates. Some research does suggest modest reductions in non‑medical prescription opioid use when medical cannabis is legalized, especially among those already using cannabis heavily, but the evidence remains weak and inconsistent. Nevertheless, lower opioid prescribing and non‑medical use in some contexts might imply safer alternatives for some patients, even if the overdose argument is not iron‑clad.

The benefit of legalization improving quality and safety is straightforward: regulated markets enforce potency limits, packaging standards, testing protocols, and age checks. Contrast that with illicit black‑market weed laced with unknown fillers, unpredictable potency, and no warnings. Regulators in states like Colorado and Illinois have enforced testing, child‑proof packaging, and quality control. While black‑market analogues remain, legalized markets bring at least a baseline of consumer safety. Reviews confirm that public health–oriented regulations matter for promoting responsible use.

Tax revenue is one of the most tangible upsides. Colorado alone pulled in $44 million in recreational cannabis taxes in 2014, rising to over $135 million in 2015, and reaching over $1 billion by 2019; those dollars have funded education, youth programs, health initiatives, and infrastructure. National-level analysis estimates that cannabis legalization raised tax revenue from $1.7 billion in 2019 to $3.7 billion in 2021 across the U.S.

Regarding crime, it’s true that legalization dramatically reduces cannabis-related arrests. In Washington D.C., possession arrests plunged by 98 percent in the year after legalization, while broader cannabis offenses dropped 85 percent. Research also suggests a slight downward tendency in violent and property crimes in states with legal cannabis compared to prohibition states—even if the difference is modest and not always statistically significant .

Public health outcomes tied to safe cannabis access depend heavily on policy design: regulating potency, packaging, retail density, marketing, driving laws, youth education and so on. Advocates argue that legalization reduces criminal justice burdens, shifts resources toward health and education, and—in theory—improves traffic safety, though critics counter that without well‑designed regulation, legalization can exacerbate harms. Meanwhile, many of our elected officials act like it’s still 1987. They’ll bend over backwards for lobbyists, pharmaceutical companies, and alcohol conglomerates — all while ignoring the will of their own voters. It’s infuriating. It’s shameful. And it’s exactly why your vote matters more than ever.

This isn’t just about cannabis.

This is about democracy. About reminding politicians who they actually work for. Spoiler alert: it’s not Anheuser-Busch. It’s not Pfizer. It’s you.
